Supreme Court grants bail to son of TMC MLA Manik Bhattacharya in money laundering case

A bench of Justices Bela M Trivedi and Pankaj Mithal passed the order after noting that the special CBI court had shown 'total non-application of mind'.

The Supreme Court on Friday granted bail to Souvik Bhattacharya, son of Trinamool Congress State legislator Manik Bhattacharya, in connection with a money laundering case.

A bench of Justices Bela M Trivedi and Pankaj Mithal passed the order after noting that the special CBI court had shown 'total non-application of mind' since it had issued summons to him without a summoning order.

The bench, thus, granted relief to the accused.

The Court also stated that the accused can move the trial court for appropriate remedies and reliefs, with all contentions of the Enforcement Directorate (ED) also left open.

The money-laundering case is connected to the West Bengal primary school teachers recruitment scam.

The trial court had earlier rejected Bhattacharya's bail plea and the same was confirmed by the Calcutta High Court leading to the appeal before the apex court.

The Supreme Court had during the earlier hearing observed that there was a need to establish institutes to train advocates before they begin practice, along the lines of judicial academies for judges in India.

The bench noted in other countries, it was an accepted norm for lawyers to secure certificates from such training academies to be able to practice.

This was after it had noticed some lapses on the part of the lawyers who handled Bhattacharya's case at the trial court stage.

Senior Advocate Sidharth Luthra appeared for Bhattacharya. Additional Solicitor General SV Raju appeared for the ED.
